These Terms of Service ("Terms") are a binding agreement between you and Cornographix ("Cornographix," "we," "us," or "our"). They govern your access to and use of cornographix.com (the "Site"), any Cornographix mobile application, and any products, services, content, and features we offer (together, the "Services"). By accessing the Site, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, our Shipping Policy, and any other policies referenced herein. If you do not agree, do not use the Services.
IMPORTANT: These Terms contain an arbitration agreement and a class-action waiver in Section 16. By using the Services, you agree to resolve disputes with Cornographix through binding individual arbitration and to waive your right to participate in a class action, except as described in that section.
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to place an order or enter into these Terms. By using the Services, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.
You may be able to create an account to place orders and track shipments. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at cxadmin@cornographix.com of any unauthorized access. We may suspend or terminate your account at any time for any reason, including violation of these Terms.
All orders placed through the Site constitute an offer to purchase. Cornographix reserves the right to accept, limit, cancel, or refuse any order at its sole discretion for any reason, including product unavailability, suspected fraud, pricing errors, or shipping restrictions. Your order is not accepted until we send you an order confirmation.
All prices are listed in U.S. dollars and are subject to change at any time without notice. Promotions, coupons, and discount codes have expiration dates and cannot be combined unless explicitly stated. Applicable taxes and shipping charges are calculated at checkout and added to your total. You authorize us and our payment processors to charge your selected payment method for the full amount of your order, including taxes and shipping.
Typographical errors, pricing errors, and inventory errors may occur. If we identify an error in a product price or description after you have placed an order, we may cancel the order and issue a full refund of any amount charged.
All sales are final. Every set we make is built to order or pulled from a limited production run. We do not accept returns, refunds, or exchanges on any product except in cases of a confirmed manufacturing defect (see Section 6). Please review your line, speed, colorway, fill, and quantity carefully before completing checkout. If you are unsure which product is right for you, contact us before you place your order.
Once your order is placed, it enters production immediately. Order changes or cancellations must be requested within 24 hours of placing the order and are granted at our sole discretion; after 24 hours, changes are not guaranteed and may not be possible. Custom orders with uploaded artwork may not be cancelled once the proof is approved.
We stand behind our construction. If a bag arrives with a confirmed manufacturing defect (bad seam, materially incorrect weight, wrong stamp, or similar issue attributable to our production), email cxadmin@cornographix.com within seven (7) days of delivery with photos, your order number, and a description of the issue. If we confirm the defect, we will repair, replace, or refund the affected bags at our sole discretion. Normal wear, break-in characteristics, color variation within stated tolerances, speed perception differences, and damage caused by use, misuse, moisture, heat, storage, or modification are not defects.
Orders typically enter production within 5–7 business days of purchase; custom orders may take longer and will be confirmed after proof approval. Delivery timelines provided on the Site are estimates only and are not guaranteed. We are not responsible for carrier delays, weather, customs processing, or other events outside our control.
Risk of loss and title to products pass to you upon delivery to the common carrier. Claims for packages lost, stolen, or damaged in transit must be filed directly with the carrier (USPS, UPS, FedEx, or other). International buyers are responsible for all duties, taxes, customs fees, and compliance with applicable import laws in the destination country.
By submitting artwork, logos, text, or other design materials for a custom order, you represent and warrant that you own or have the necessary rights, licenses, and permissions to use the submitted content, and that the content does not infringe the intellectual property, publicity, privacy, or other rights of any third party and does not violate any law. You grant Cornographix a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your submitted content solely for the purpose of producing and fulfilling your order and for internal portfolio and promotional use, unless you expressly request otherwise in writing before production.
You agree to indemnify and hold Cornographix harmless from any claim, loss, or liability arising out of submitted content, including claims of infringement. Cornographix reserves the right to refuse any custom order for any reason, including content we consider unlawful, obscene, hateful, defamatory, or outside our production capability, and to issue a full refund if production has not begun.
We strive to accurately describe our products, including dimensions, weights, fabrics, fills, speed ratings, and certification status. However, minor variations may occur between photographed samples and production units due to dye lot, monitor color calibration, lighting, and natural material variance. Product availability is not guaranteed and may change without notice. We reserve the right to modify, discontinue, or limit any product at any time.
Speed ratings are subjective. Speed numbers reflect the manufacturer's characterization and are influenced by break-in, board surface, temperature, humidity, and player technique. No outcome is guaranteed.
You agree not to: (a) use the Services for any unlawful purpose or in violation of any local, state, national, or international law; (b) infringe or misappropriate the intellectual property rights of Cornographix or any third party; (c) upload, post, or transmit any content that is harmful, threatening, harassing, defamatory, obscene, hateful, or otherwise objectionable; (d) interfere with or disrupt the Services, servers, or networks; (e) attempt to gain unauthorized access to any portion of the Services; (f) use automated means such as bots, scrapers, or crawlers to access, copy, or monitor the Services without our express written permission; (g) introduce malware, viruses, or other harmful code; (h) reverse engineer, decompile, or disassemble any part of the Site or its software; (i) impersonate another person or misrepresent your affiliation; (j) engage in fraud, chargebacks, or payment-dispute abuse; or (k) resell Cornographix products without our written permission.
The Site and all its contents — including text, graphics, logos, product photographs, designs, videos, audio, software, and the "Cornographix" name and marks — are owned by Cornographix or its licensors and are protected by United States and international copyright, trademark, trade dress, patent, and other intellectual property laws. You are granted a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, distribute, publish, transmit, display, modify, create derivative works from, sell, or commercially exploit any Site content without our prior written consent. All rights not expressly granted are reserved.
If you post reviews, comments, images, or other content to the Site or our social channels ("User Content"), you grant Cornographix a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in any media for any lawful business purpose. You represent that you own or have the necessary rights to grant this license. We have no obligation to monitor, display, or retain User Content and may remove it at our discretion. Any suggestions, feedback, or ideas you submit to us are non-confidential and may be used by Cornographix without compensation or attribution.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. CORNOGRAPHIX EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED. WE MAKE NO WARRANTY REGARDING TOURNAMENT LEGALITY, PERFORMANCE, OR ELIGIBILITY OF ANY PRODUCT IN ANY SPECIFIC EVENT, LEAGUE, OR GOVERNING BODY; STANDARDS AND REQUIREMENTS ARE SET BY THIRD PARTIES AND MAY CHANGE WITHOUT NOTICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CORNOGRAPHIX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT PURCHASED FROM US, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORNOGRAPHIX'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICES, OR ANY PRODUCT SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO CORNOGRAPHIX FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THIS LIMITATION APPLIES REGARDLESS OF THE CAUSE OF ACTION AND IS A FUNDAMENTAL ELEMENT OF THE BARGAIN BETWEEN YOU AND CORNOGRAPHIX. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.
You agree to defend, indemnify, and hold harmless Cornographix, its affiliates, and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; (d) any content you submit, post, or transmit through the Services, including custom-order artwork; and (e) any misuse, modification, or combination of our products with other products or materials.
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before filing any formal claim, you agree to first contact us at cxadmin@cornographix.com and make a good-faith attempt to resolve the dispute for at least thirty (30) days.
Binding arbitration. Except for the exceptions below, any dispute, claim, or controversy between you and Cornographix arising out of or relating to these Terms or the Services shall be resolved through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be in the United States, and where feasible the arbitration may be conducted by telephone, video, or on written submissions. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
Class-action waiver. YOU AND CORNOGRAPHIX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property rights. Claims regarding the validity or enforceability of the class-action waiver shall be decided by a court, not an arbitrator.
Opt out. You may opt out of the arbitration agreement and class-action waiver by sending written notice to cxadmin@cornographix.com with the subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out. Opting out will not affect any other provision of these Terms.
Thirty-day limitations period. Any claim arising out of or relating to these Terms or the Services must be filed within one (1) year after the claim arose; otherwise, it is permanently barred.
These Terms and any dispute arising out of or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of the State in which Cornographix maintains its principal place of business, without regard to its conflict-of-laws principles. Subject to Section 16, any action not subject to arbitration shall be brought exclusively in the state or federal courts located in that State, and you consent to the personal jurisdiction of and venue in those courts.
We may update these Terms at any time, in our sole discretion. The "Last updated" date at the top of this page will reflect the effective date. Material changes will be highlighted where required by law. Your continued use of the Services after any changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.
We may suspend or terminate your access to the Services, without notice or liability, for any reason, including if you breach these Terms. All provisions that by their nature should survive termination — including intellectual property, disclaimers, indemnification, limitation of liability, dispute resolution, and governing law — shall survive.
These Terms, together with our Privacy Policy and Shipping Policy, constitute the entire agreement between you and Cornographix and supersede all prior understandings. If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them freely. The Services are offered from the United States, and we make no representation that they are appropriate or available in other jurisdictions. No agency, partnership, joint venture, or employment relationship is created by these Terms. Headings are for convenience only.
